New Delhi: Jamiat Ulema-e-Hind Chairman Maulana Mahmood Madani welcomed the Supreme Court’s verdict on the Madarsa Commission. “The Supreme Court’s ruling should be welcomed,” he said. “There have been complaints that our courts, especially the lower courts, feel that their decisions violate justice in many cases.”

Maulana Mahmood Madani said a similar decision was taken by the High Court declaring these schools illegal and the system governing madrassas itself was termed unconstitutional. The Supreme Court gave a good judgment today and made some observations.
Madani said the CJI had said, “Coexist and let coexist”. This sentence has many meanings. Today, Muslims in India are frustrated. There are many reasons for this. I think this decision will be a relief for everyone. I congratulate the UP Madrasa Board Association, Teachers Association for their struggle.
Madani said the Supreme Court’s statement was an important message at a time when community forces and many ministers in power have openly called for violence and attacked the existence of madrassas.
What’s going on?
In fact, a three-judge bench of the Supreme Court ruled on the constitutionality of the UP Madrasa Act and the Supreme Court declared the UP Madrasa Board Act, 2004 constitutional. This means that the constitutionality of the UP Madarsa Commission is maintained. Despite the omission of some provisions, the constitutional validity of the Uttar Pradesh Madrasa Education Board Act, 2004 remains.
It is worth noting that earlier on March 22, the Lucknow bench of the Allahabad High Court declared the UP Madrasa Board Act unconstitutional and ordered that all students be admitted to regular schools. However, this decision of the High Court was stayed by the Supreme Court on April 5.
