The matter became so complicated that the Nazul Land Bill introduced by the UP government was stopped in the Legislative Council after being passed in the Assembly. Whereas the government also has absolute majority in the Legislative Council.

In fact, the Yogi government had brought the UP Nazul Property (Management and Utilization for Public Purposes) Bill, 2024 with the intention of making the Nazul land of UP available for development schemes. The Nazul Land Bill was approved in the cabinet meeting chaired by CM Yogi Adityanath on Wednesday. After this, the bill was presented in the Assembly by Parliamentary Affairs Minister Suresh Khanna. While presenting the bill, the government said that this law is being brought to provide relief to the economically weaker sections. Along with this, it was also told that the provision for vacating the land from the poor has not been brought in the bill.

This law is being brought to meet the continuous and immediate need of land due to development schemes of public importance. Despite this, the way the law was suddenly stopped from being made by talking about the roof being taken away from the heads of the poor, it undoubtedly does not give the right message for BJP. If the bill had to be stopped, it would have been stopped earlier by discussing amongst ourselves. At least the opposition does not get a chance to attack.

1-The struggle between power and organization is still going on in UP.

After the Lok Sabha election results, in the BJP working committee meeting in Uttar Pradesh, Deputy CM Keshav Prasad Maurya had said that it is a bigger organization than the government. Which was believed to be Keshav Prasad Maurya’s attack on the Yogi government. Later on many occasions Keshav Prasad Maurya said similar things. Although the Yogi government got the bill related to Nazul land passed in the Legislative Assembly, BJP State President Bhupendra Chaudhary opposed it in the Legislative Council and forced the bill to be sent to the Select Committee. If Choudhary had any complaint about the bill or if the opposition suddenly increased, then there was a need to sit together and resolve it. If necessary, the bill would have been stopped. Suddenly stopping the bill in the Legislative Council means that either the Chief Minister is not listening to the organization or the organization has not talked to the Chief Minister. Obviously this means that the struggle is still going on in the party. If there was so much internal opposition in the party regarding a bill, there was no need to introduce it in a hurry. There was no such important bill that it could not wait for a few more months.

2-What does the organization want to show by stopping the bill?

This is the first time after the BJP government came to power in UP, that after passing a bill in the Assembly, the state president of that party has got it pending in the Legislative Council by opposing the bill. In such a situation, the question will arise that if this bill was to be sent to a committee, then why was it brought in the Legislative Assembly? And if it was stopped in the Assembly itself, why was it not sent to a committee? Is it possible that this was done so that the message could be given that the organization is heavier than the government. Because the leader of the House in the Legislative Council is Keshav Prasad Maurya and Bhupendra Chaudhary is also in the Legislative Council. Chukchi Legislative Council Chairman Kunwar Manvendra Singh accepted the request of Bhupendra Chaudhary and sent the bill to the Select Committee, which clearly means that this opportunity is not available in the Assembly. Obviously, Bhupendra Chaudhary would not have become an obstacle in the way of a similar bill in the Legislative Council. If Prayag Raj MLAs Siddharth Narayan Singh and Harsh Vajpayee felt that this would cause a lot of damage then they should have raised the issue earlier. At least the Uttar Pradesh government is not defamed. In this way, BJP directly suffered loss. A direct message was sent to the general public that the relationship between the government and the organization is actually very bad.

3-There was a provision to ensure that the poor do not lose their roof.

The biggest argument being given to stop the bill is that it will destroy the lives of millions of poor people. But while presenting the bill, Suresh Khanna had said that there is no provision in the bill to make the poor vacate their land. The government had clarified that those who have deposited the lease amount on time, their lease will be renewed for 30 years. It was also said that schools, colleges, hospitals and government institutions will remain the same. The government had also assured that the rules will be made in such a way that the poor are not oppressed in any way. But the narrative was set in such a way that if the bill is passed, hundreds of schools and colleges will be demolished. One MLA even said that the High Court building has also been built on Nazul land, so will the government demolish that too? Suresh Khanna had clarified that it takes a lot of time to arrange land for public welfare works. Now Nazul land will be used only for public works.

4- Land mafia is enjoying Nazul land in the name of poor.

There are more than 28 thousand hectares of Nazul lands in different cities of Uttar Pradesh. Maximum land is in Prayagraj. That is why there is maximum opposition from the leaders there. Nazul land is generally used for public purposes like construction of schools, hospitals, gram panchayat buildings etc. A lot of Nazul land has been given on lease to the people. The lease holders have sold the land at many places and got it registered. Some people are building houses and living there while some are also doing their own business. But several thousand acres are under occupation by the land mafia. Have also done. Newspaper reports from many cities of Uttar Pradesh show how the land mafia is in control. The land mafia is having fun in the name of poor people.

The news published in Dainik Jagran on April 2, 2024 states that more than 100 such Nazul plots have been identified in Basti district which are occupied by others. During investigation, the Tehsil administration found that a case of encroachment of ten plots in the Civil Lines area has come to light. Residential and commercial constructions have taken place on these plots. Tent businessmen, marriage hall businessmen and even LPG agency holders have been included in this. Apart from this, people encroaching on Nazul land in other parts of the city are also being identified. According to the Tehsil administration, more than a hundred encroachers have been identified. To whom serial notices will be issued.

The news of Lucknow Dainik Jagran on 15 March 2020 states that about 100 acres of LDA land in the capital is a victim of illegal encroachment. There is also illegal occupation of about 14 hectares of Nazul land. LDA has completely forgotten this entire campaign for the last one and a half years. After the coming of Yogi government, action was taken on strict orders from the Chief Minister. In which by the end of the year 2018, LDA had identified some land mafias. Some illegal encroachments were also removed. Under the anti-land mafia campaign, only 14 land mafias were identified in the entire city. Barring one or two of these, LDA has not been able to remove the land mafia’s encroachment on government land.

The news of Dainik Jagran in Gorakhpur on 18 March 2020 states that

Many people have also forgotten that there once used to be a pond here. The land mafia has built a warehouse on the land located in the middle of the lake and has given it on rent. To maintain the land, more than a hundred Rohingya families were brought and settled there. In the revenue records, 15 acres of land is recorded as Tal Sumer Sagar and seven acres of land is recorded as Nazul land.

The news published in Bareilly Amar Ujala on March 13, 2020 states that the Jubilee Park, where Mahatma Gandhi once visited, is missing. Sanjay Community Hall, Allen has been built on the land within the boundaries of the park without changing its land use. Many government buildings including the club, fire brigade and mayor’s residence were constructed. On the instructions of the then Commissioner, the file buried in the Collectorate of Jubilee Park built on Nazul land was taken out. In the government records, 3.743 hectares of land is registered at Gate No. 81 in the name of Jubilee Park, but on the spot there are Sanjay Community Hall, Allen Club, Mayor’s residence along with the fire department’s office, shops on the other side of the road in front of the Municipal Corporation, Sitapur Eye Hospital. There are shops and other constructions at the rear. There is 0.923 hectare land on Gata No. 82. Although the old pond still exists near Sanjay Community Hall, its area at that spot is not clear.

5-Why are BJP leaders of Prayagraj more worried?

If media reports are to be believed, there are about 1300 hectares of Nazul land in Prayagraj, on which people have been living by building houses for generations. Perhaps this is the reason why the BJP MLAs and leaders of Prayagraj region are opposing the Nazul land related bill of the Yogi government the most. Be it BJP MLA Siddharth Nath Singh from the western seat of Prayagraj or Harsh Vardhan, MLA from the city’s northern seat, both strongly opposed the bill. Raja Bhaiya’s influence is believed to be in Prayagraj, perhaps this is the reason why he is very vocal about opposing this bill. This area is also considered to be the area of ​​Deputy CM Keshav Prasad Maurya himself. A large part of the areas near Khusro Bagh, Civil Lines, Ashok Nagar, Rajapur, Lukerganj, Shivkuti and Georgetown of Prayagraj is situated on Nazul land.
