It has been 14 days since the Kolkata incident. Fellow doctors are on strike to get justice for the daughter. This entire incident came to light on 9 August. The body of a 31-year-old female trainee doctor was found in the seminar hall on the third floor of RG Kar Medical College Hospital. Her clothes were missing from her body. She was bleeding. There were marks of injuries on her body. After the incident, the resident doctors became angry and went on strike. The police arrested the accused Sanjay Roy and sent him to jail. After 5 days, the High Court transferred the case from the police to the CBI. Two days ago, the Supreme Court took suo motu cognizance of the case and ordered the CBI to file a progress report of the investigation so far. 1. It was not gang rape but rape?

CBI is continuously working to get to the bottom of the matter. Aaj Tak has made a big disclosure in the rape and murder case of a female doctor. The clues and evidences that CBI has found so far in this case do not confirm gang rape. According to the forensic report and CCTV evidence, only the involvement of accused Sanjay Roy has been confirmed so far. CBI is now preparing to get the forensic report examined by a private expert to find out the involvement of anyone else in the crime.

2. Was Sanjay Roy the only person involved in the incident?

The most important question is whether the arrested accused Sanjay Roy was alone in this incident or there are many other accused with him. According to the information, the facts that have come to light in the CBI investigation with reference to the forensic report indicate that Sanjay Roy has committed the crime of rape and murder. In the Kolkata rape and murder case, former principal of RG Kar Medical College, Sandeep Ghosh, is continuously in the headlines. On Thursday, the CBI team is questioning Sandeep Ghosh for the seventh consecutive day. The investigating officer has so far questioned Sandeep for about 77 hours in six days. 4. Will CBI arrest Sandeep Ghosh?

The victim had lunch with 4 interns of Sandeep Ghosh, CBI has also questioned them. Also, technical investigation of the former principal’s car has been done. Forensic experts have collected information about the movement of the car. Also, it is being investigated whether some items were taken from the car. The driver has been questioned in this regard. On the other hand, CBI has also questioned RG Kar Hospital’s Medical Superintendent and Vice President Sanjay Vashisht and Sanjay Vashisht has also been removed from his post.

6. Why questions on Kolkata Police again?

The Supreme Court has again reprimanded the Kolkata Police. Justice JB Pardiwala said, I have not seen such a negligent case in my 30 years of career. The court expressed suspicion of tampering with the crime scene. The CBI’s status report claims that the Kolkata Police cordoned off the crime scene after the post-mortem. There was a delay of 14 hours in the FIR. The court questioned how the post-mortem was done before the unnatural death was registered? The magistrate’s report was also questioned. The court said that it seems that some pages were added later. In the hearing two days ago, the court had also expressed displeasure over the incident of intrusion into the hospital.

7. What arguments did the government give?

Senior advocate Kapil Sibal, on behalf of the West Bengal government, said, as far as unnatural death is concerned, we have followed all the guidelines. Its entire videography has been done and I have the entire timeline. The CJI said, but this does not justify your filing an FIR at 11:30 pm. The body was recovered early in the morning. The CJI said, why was the FIR registered after 14 hours? He was the principal of the college, who was in contact. Why was the principal immediately transferred to another place? The SC told the West Bengal government’s lawyer to keep the responsible police officer present in the court during the next hearing. Who has knowledge about the case. Justice Pardiwala told the West Bengal government that you tell me when did you mention in the police diary that it was an unnatural death before the FIR. The conduct of the Assistant Superintendent of Police is also very suspicious. Why did he do this?

8. What did CBI say on FIR?

Solicitor General Tushar Mehta said that the police’s allegation that the doctor’s father, shocked by her death, had initially asked not to file an FIR is completely wrong. Later, the FIR was registered on the father’s request. The SG said that the FIR was not lodged by the hospital but by the victim’s father. The CBI also said that the family was also informed about the incident late.

9. On which questions was the hospital administration surrounded in the court?

CJI asked Sibal, according to the DD entry, unnatural death was registered at 10.10 am and then why was it registered in the FIR at 11.30 pm? This is disturbing. SC asked, if it was not an unnatural death then why was the post-mortem done? SC said, FIR was registered at 11.30 pm on 9 August. This is a very shocking case. SC asked West Bengal Police, when did you register the UD (unnatural death) case? SC again asked the West Bengal government, why is it taking so much time? Justice Pardiwala asked, when was the post-mortem done? Sibal said, between 6:10 pm and 7:10 pm. He asked how was the post-mortem done at 18.10 pm on 9 August? Because the lady doctor died an unnatural death and yet the information about the unnatural death was sent to the police at 11.30 pm on 9 August, this is very disturbing. Though the rape-murder happened on the night of August 8-9, the police were informed about the crime only at 10.10 am on August 9. What were the hospital authorities doing for so long?

10. What is the Supreme Court’s instruction to the Bengal government?

The bench said, during the hearing, the lawyers have given some suggestions, in which there is a demand to regulate duty hours and create a fund for compensation. The expert committee formed by us i.e. the National Task Force will look into these suggestions. A portal should be opened in this matter in which people can give their suggestions. In his order, the CJI told the West Bengal government that it will not take any action against those protesting peacefully. The matter will be heard next week. Sibal said that he wants to say something to the court. The SG also said that he also wants to say something. The CJI again appealed to the doctors who went on strike and said, they should return to work. The Supreme Court has directed the CBI court to pass an order on the polygraph test of Sandeep Ghosh by 5 pm tomorrow.
