‘Under what circumstances was the petitioner’s house demolished…, Allahabad High Court is also strict on bulldozer action

The High Court has expressed strong displeasure over the demolition of a house by bulldozer in Azamgarh, UP without following the legal process. This stand of Allahabad High Court has come after the Supreme Court’s stand on bulldozer. The court has asked the UP government what were the circumstances due to which the petitioner’s house was demolished without following the legal process.

The court has asked the UP government to file a reply in this matter. Let us tell you that on July 22, the Additional Collector of Azamgarh had issued an order to demolish Sunil Kumar’s house regarding the land dispute. It is alleged that without giving Sunil Kumar any opportunity to be heard, a bulldozer was run on his house.

The case was heard in a single bench of Justice Prakash Padia. Now the High Court will hear the case on 18 September. In such a situation, the state government will have to file its reply by 18 September.

Did the Supreme Court raise questions on the bulldozer action?

The Supreme Court had recently heard the case on ‘Bulldozer Justice’. The apex court had raised many questions while making a strong comment on it. While hearing a case from Gujarat, the court of Justice Hrishikesh Roy, Justice Sudhanshu Dhulia and Justice SVN Bhatti has said that a bulldozer cannot be run on a person’s house merely because he is an accused in a case.

It is the court’s job to decide whether the accused is guilty or not, i.e. whether he has committed this crime, not the government’s. In this country governed by law, a person’s mistake cannot be punished by taking such action against his family or by demolishing his house. The court cannot ignore such bulldozer action. Allowing such action to happen would be like running a bulldozer on the rule of law itself.

SC gave this order while hearing the petition of a petitioner named Javed Ali from Gujarat. The petitioner said that due to an FIR against a family member, he has been threatened with demolition notice from the Municipal Corporation. In this case, the Supreme Court had issued a notice to the corporation and the local administration, ordering to maintain the status quo for the time being.
