TikTok Technology Canada Inc. has applied for judicial review to challenge a Canadian order requiring China’s ByteDance Ltd. to close its subsidiary in the country, citing national security risks.
The company argued in documents filed with the Federal Court of Canada in Vancouver that the government’s order was disproportionate and exceeded the officers’ legal scope; that the national security review was procedurally unfair; and that the conclusion of national security harm was “unreasonable.” . The filing calls for the order to be revoked.
detail
The documents, filed on Dec. 5, describe a relationship between TikTok and Canadian officials that began with “routine discussions” but grew stronger over the years. By March 2023, Canadian officials began issuing requests for information that lasted a year and a half, and in September 2023, a national security review was launched, which was extended twice, the document said. The filing said TikTok was not properly notified about addressing Canada’s concerns before the shutdown order was issued.
TikTok’s Canadian unit sells advertising space, and the platform itself is provided in Canada by TikTok Pte, a Singaporean company that is also the data controller of Canadian user data, the filing said.
background
The video-sharing platform has more than 14 million monthly users in Canada, accounting for one-third of the country’s roughly 42 million people. The document adds that TikTok Canada is “partnering with Elections Canada and the Privy Council Office on the app to support electoral integrity” during the 2021 federal election.
A spokesman for Industry and Science Canada said the government’s decision was based on a “thorough national security review and advice from Canada’s security and intelligence communities” and that it respected the legal process but stood by its decision. Canadian media reported on the document earlier Tuesday.
