SUV driver Manuj Kathuria got a big relief on Thursday in Delhi’s Old Rajendra Nagar coaching case. He was made an accused in the coaching accident case that took place in the capital. On Thursday, Tis Hazari Court of Delhi granted him bail. Written order of the court has come regarding the bail of SUV driver Manuj Kathuria. The court said, ‘The police out of excitement made the SUV driver an accused and also registered a case against him under section 105 of the BNS section of culpable homicide not amounting to murder. The court said, the police itself has admitted in its written reply that in the investigation so far, no case has been made out against the SUV driver under section 105 of BNS (culpable homicide not amounting to murder). The remaining sections under which Manuj Kathuria has been made an accused are all bailable sections.

The court granted bail on these conditions
The court has placed a bet on Kathuria. The condition is that he will cooperate in the investigation, will not tamper with the evidence and will not influence the witnesses by contacting them. In case of change of address, we will inform the police and court. Will not give any statement regarding this case in print or electronic media.

What is the whole matter?
An accident took place in the basement of Rau’s IAS Coaching Center in Old Rajendra Nagar, Delhi on the evening of 27th July due to water filling after rain. During this period, three students studying in coaching had died. In this case, the police had registered an FIR and formed several teams to investigate the accident. The police had arrested the owner of the coaching center, Abhishek Gupta and the co-ordinator.

The arrest was made on the basis of CCTV footage
In fact, after the accident, it was revealed in a CCTV footage that a car had passed at high speed from the water-filled road outside the coaching centre. Only after this, water started entering the coaching center because the gate of the center was broken due to the pressure of water. On the basis of the video, the police arrested the driver of the vehicle as an accused and presented him in the court on Tuesday. Bail was sought from the court on behalf of the accused, which was opposed by Delhi Police.

What arguments were put forward in Tis Hazari Court?
During the hearing in Tis Hazari Court of Delhi, both the parties presented their respective arguments. During this, the accused’s lawyer had argued that he was simply driving the car. It is difficult to drive a car in such a situation, whereas they (police) say that the car moved at such a high speed. They are trying to make him the main accused and the main criminal. What choice did I have? Should I have knocked on every door and asked if I could take my car through? According to them, driving a car at high speed is a crime here.

These questions were raised in the court
Did they arrest me for reckless driving? No. People are hoping that the real culprit will be caught. Now the hope is from the court. The institution itself is guilty. How can a third party be made an accused? Notice has been issued to MCD officials. Why was I not given notice?

Delhi Police had given this argument
Delhi Police, while opposing the bail plea of ​​the accused, said that the car driver is a fun-loving person and the accident happened because of his fun. The court has reserved the decision after hearing the arguments of both the parties.
