Justice Dutta expressed his displeasure
Justice Dutta’s dissent highlighted the difficulties he faced due to the lack of a consultative decision-making process. Judge Dutta’s opinion stated that as a result of this series of events, he had to take time off to pursue other judicial duties.
First, he narrated how he received the CJI draft on October 17. This arrived about three weeks before his retirement.
The decision is reserved until February 1, 2024
Hearings on these appeals and petitions begin on January 9, 2024. During the marathon hearing which lasted for eight (eight) days, detailed arguments were made by the learned senior counsel/counsel. The decision is reserved until February 1, 2024.
He said the decision had not yet been handed over to me, which apparently left me no choice but to wait for the submissions to arrive at my residence, and the wait continues.
Justice Dutta said that it was not until October 17, 2024, that the draft opinion was written by Hon. Dutta. The Chief Justice of India, as President, placed 117 pages on my desk.
