Supreme Court increases compensation for road accident victims – Marriage is an integral part of life, says judge

The Supreme Court said on December 11 that marriage or cohabitation is an integral part of a person’s natural life. To make this clear, the court increased the compensation to Rs 50.87 lakh for a woman who suffered from 75% intellectual disability due to a road accident. A bench of Justices BRGavai and KVViswanathan mentioned one such woman. He said the woman was 7 years old when she was involved in a car accident in 2009. A medical examination revealed that he suffered from moderate intellectual disability.

The bench said her body would continue to grow efficiently but she would always remain a little girl. The court stated that the appellant (female) not only lost her childhood, but her adult life was also affected. She may have become like this, but marriage and living together are an integral part of a person’s natural life. However, the court also recognized that the woman may have had the ability to bear children. However, it is almost impossible for him to experience the normal pleasures of married life.

Court increases woman’s compensation

The court increased the woman’s compensation to Rs 50.87 lakh. The woman appealed to the Supreme Court against the November 2017 order of the Delhi High Court. The High Court ordered him to pay compensation of Rs 11.51 lakh.

The Supreme Court said that a woman will be dependent on someone throughout her life. Even as an adult, she is still mentally like a second-class child. The court said that in June 2009, the woman was hit by a speeding car while walking with her family. A claim was filed under the Motor Vehicles Act, 1988 and he was awarded Rs 5.90 lakh as compensation. Subsequently, a petition was filed in the High Court on behalf of the woman to increase the amount of compensation, which was eventually increased to Rs 11.51 million.
