While banning bulldozing operations, the Supreme Court also informed the circumstances under which its ruling would not apply. Delivering its judgment on Wednesday, the Supreme Court said its directive does not apply where unauthorized construction takes place on public land. There are also places where courts have ordered demolition.
The Supreme Court said the government which used bulldozers indiscriminately was guilty of taking the law into its own hands. Building a home is a constitutional right. The right to housing is a fundamental right. The court further said that a house is not just a property but a home for the entire family and before demolishing the house, the state should consider whether it is necessary to take such an extreme step of depriving the entire family of their home.
