Special court to hear cases of five appointed MLAs… High Court approves formation

The assembly elections in Jammu and Kashmir have been completed. The new chief minister has also been sworn in in the state, but issues related to the election remain controversial. This issue involves the appointment of five MLAs by the Lieutenant Governor. During the assembly elections, state local government Manoj Sinha appointed these MLAs as members of the Jammu and Kashmir Assembly.

The opposition challenged LG’s decision, calling it unconstitutional. Some people even went to court over it. Now in response to this matter, the Jammu and Kashmir and Ladakh High Courts have constituted a special court that will hear the case.

Chief Justice agrees

Justice Tashi Rabastan agreed to constitute a special bench after hearing a PIL on the issue of nomination of five MLAs to the Assembly, Chief Justice of Jammu and Kashmir and Ladakh High Court.

On Monday, petitioner Mr. DK Khajuria and JKPCC spokesperson Mr. Ravinder Sharma filed a petition seeking an early hearing on the issue, which the Chief Justice accepted.

Complainant Khajuria said the matter was very important. He told the court that senior Supreme Court lawyer Dr Abhishek Manu Singhvi would argue in the case. During the argument, Khajuria also read out the Supreme Court order directing him to approach the High Court.

Accused of stealing authorization

The opposition accused the deputy governor of stealing the mandate when he nominated five MLAs in the election results. The opposition said that if the PPP won less than a majority in the election, it would try to use these nominated MLAs to gain a majority.

However, things calmed down a bit after the National Congress secured a majority. Let us tell you that when the central government made the state a federal territory, it had stipulated that the five MLAs of the state would be nominated by the local government.
