The Supreme Court issued a major order in the temple-masjid case pending before the lower courts. Lower courts will no longer issue any interim or final rulings on cases involving temples and mosques. No investigation will be ordered into any mosque anywhere. Currently, no new cases regarding temples and mosques will be initiated in any court. In older cases that are ongoing, lower courts can hear the cases but cannot issue any orders.

During the hearing on an application filed under the Places of Worship Act, 1991, the Supreme Court asked the central government to respond in the matter within four weeks and stayed the lower courts from issuing any orders in temples until the next hearing: mosques dispute.

While parties sought stay of lower court proceedings in 18 cases including Krishna Janmasthan and Shahi Idgah in Mathura, Bhojshala dispute in Dar, Atala Majid dispute in Jaunpur, Shivling dispute in Khwaja Dargah in Ajmer, the Supreme Court refused Suspension of proceedings. court proceedings, but ordered lower courts to take no effective action in such cases until the next hearing by the Supreme Court. The central government now has four weeks to present its position on the Places of Worship Act 1991. Over the next four weeks, litigants will have a chance to respond to the central government’s position, meaning disputes related to temples and mosques will be eased for at least the next two months.

Muslims hailed the Supreme Court order as a major victory. The Hindu said the Supreme Court just followed procedure and the order was no big deal. Lawyers are interpreting the Supreme Court order in their own way, talking about legal complexities, but the bottom line is that the Places of Worship Act provides that the character of a religious place that existed in 1947 will remain unchanged. It cannot be changed, that is, the mosque there will remain a mosque and the temple there will remain a temple.

Since a lower court ordered an investigation into Gianwapi’s case, there has been a sudden surge in such cases. Besides Mathura, an inquiry has also been ordered in Bhojesala of Dhar. The order to conduct an inquiry in Sambhar was then received within two hours of the application. As a result of this incident, violence broke out in Sambal, leaving five people dead.

A petition has been filed regarding Khwaja’s Dargah in Ajmer. Vishnu Shankar Jain and Harishankar Jain said they have prepared at least a dozen such documents.
