Earlier in February 2024, the Supreme Court had given a big decision on the two-child policy. Rajasthan’s ‘no government job if there are more than two children’ rule was challenged in the Supreme Court. While giving its verdict on this, the Supreme Court had said that refusing to give a government job for having more than two children is not discriminatory. The court had said, the rule disqualifies candidates for government jobs if they have more than two living children and it is not discriminatory. The court had clarified that the purpose of this rule is to promote family planning.
Let us tell you that there are many rules regarding the two-child policy in Maharashtra. The Government Resolution of 2001 states that if an employee has more than two children, then after his death, no member of his family will be given compassionate appointment. At the same time, there is a provision in the Civil Rules implemented from 2005 that if one has more than two children, then he will not be eligible for a government job.
After the implementation of these rules, if an employee has a third child, he will be disqualified for a government job. These rules apply to employees recruited in A, B, C and D groups. Similarly, in Maharashtra, if a person has more than two children, he is also barred from contesting local elections. People with more than two children cannot contest Panchayat and Zilla Parishad elections.
