On Friday, the Mumbai High Court transferred the trademark dispute between the real estate tycoon and his brother Abhishek Lodha and Abhinandan Lodha to mediation. The dispute was carried out under the supervision of the former Supreme Court judge.

The single judge of Dr. Arif, a judge, has been awarded five weeks to promote solutions. The hearing is scheduled to be held on March 21.

The court emphasizes the nature of the controversial family, and the importance of mediation on extending litigation is emphasized. “Have you worked hard to sit down to solve it?” The court made a comment earlier.

Darius Khambata, a senior legal adviser to the Macrotech Developers LTD (Lodha Group) representing Abhishek Lodha, replied that his clients are open to mediation as long as it maintains time limit.

“I’m glad to participate in the mediation process … Abanan is my brother and has a lot of love for him. I have always supported him in any possible way and hoped his success. I hope this mediation process can help us reconcile Difference, “said Abhishek Lodha.

Origin of dispute

The conflict can be traced back to 2015, when the Lodha brothers decided to separate.

Abhinandan launched the house of Abhinandan Lodha (Hoabl), and Abhishek continued to lead the family real estate business of the developer of Macrotech.

Their separation was officially formulated by the family reconciliation agreement in March 2017. The agreement was awarded ABHISHEK’s control of real estate business, and Abhinandan focused on companies outside the industry. The agreement will also be assigned all intellectual property related to real estate, including trademarks, to Macrotech.

A non -competitive clause prohibits Abhinandan from engaged in real estate activities in the Mandarin Metropolitan area for five years, and has performed specific duration in Greater London. A agreement in December 2023 reiterated the restrictions on the name similar to the name of the “Lodha” brand, including “Lodha Ventures”.

Macrotech’s allegations

Macrotech has accused Abhinandan’s company infringing its registered “Lodha” trademark. In September 2024, Macrotech asked Abhinandan’s companies to use the names of “Lodha” and “Lodha Group” and issued a free statement to clarify that it had no affiliation with Macrotech.

Abhinandan’s company acknowledged the name “Lodha Ventures”, but did not discontinue Macrotech marked as a domain name infringing on its trademark.

Macrotech believes that Abhinandan’s action is intentional. He believes that the trademark used by his company is very similar to the registered trademark of Macrotech, and may mislead consumers believe that the company has connected.

Legal requirements

Macrotech is seeking restrictions on ABHINANDAN, directors, shareholders, and colleagues to use the “Lodha” trademark or any permanent ban on a similar name. It also tries to prevent the defendant’s marketing or provide services that may cause consumer chaos.

In addition, Macrotech requires Bleak500 billion compensation for trademark infringement, and required disclosure of the defendant’s financial records to safeguard its interests. The company also called on destroying all materials with infringement trademarks.
