Krishna Janmabhoomi-Shahi Eidgah dispute: HC will give important decision tomorrow on 15 petitions of Hindu-Muslim side

Allahabad High Court can give a big decision on Thursday in the case of Shri Krishna Janmabhoomi and Shahi Eidgah. The court will give its verdict on this matter at 2 o’clock. Let us tell you that after the completion of the hearing in this case on June 6, the High Court had reserved its decision. The court will give its verdict on the petitions challenging the maintainability of the cases filed in connection with the Krishna Janmabhoomi-Shahi Idgah Mosque dispute in Mathura.

In fact, on June 6, Justice Mayank Kumar Jain had reserved his decision on the petition filed by the Muslim side regarding the maintainability of the cases. Several lawsuits have been filed seeking the “removal” of the Shahi Idgah Mosque located adjacent to the Krishna Janmabhoomi temple, with the plaintiffs claiming that the Aurangzeb-era mosque was built after the demolition of the temple. The Mosque Management Committee has challenged these cases in its petition. Let us tell you that the decision will be taken on a total of 15 petitions related to Shri Krishna Janmabhoomi and Shahi Idgah.

The Muslim parties – Mosque Management Committee and UP Sunni Central Waqf Board – have argued that the lawsuits are barred under the Places of Worship Act 1991. According to the Muslim side, the suits themselves admit the fact that the mosque in question was constructed in 1669-70.

Know what has happened so far
In the petitions filed by the Hindu side, it has been claimed that the mosque has been constructed on 13.37 acres of land of Katra Keshav Dev Temple. Let us tell you that on December 14, 2023, Allahabad High Court had accepted the application demanding formation of Advocate Commission for court-monitored survey of Shahi Idgah Mosque complex adjacent to Shri Krishna Janmabhoomi Temple in Mathura. This order of the High Court was challenged by the Muslim side in the Supreme Court. After this, on January 17, on the petition of the Muslim side, the Supreme Court had stayed the order constituting the Advocate Commission by the Allahabad High Court, but the Supreme Court had made it clear that under Order 7 Rule 11 of the CPC, including the stability of the case. Hearing in the dispute will continue before the Allahabad High Court.

After the Supreme Court’s stay order, the Hindu side had also filed an application demanding a revenue survey in the Allahabad High Court. In May last year, Allahabad High Court had transferred all the cases related to Shri Krishna Janmabhoomi-Shahi Idgah Masjid dispute from Mathura Court to itself. Let us tell you that the Muslim side is arguing that the petitions filed by the Hindu side are not maintainable.

The Muslim side has also presented an argument regarding the agreement made in 1968. Under this, 13.7 acres of land of Keshav Dev Katra has been given to the Shahi Idgah Mosque. Along with this, the Muslim side has cited the Places of Worship Act, Limitation Act, Waqf Act and Special Relief Act of 1991. This case is hindered by these four Acts, hence its hearing cannot be held here. The single bench of Justice Mayank Kumar Jain will give its verdict on this matter.
