Kolkata incident: Victims’ names and photos available on Wikipedia, SC issues strict orders

The Supreme Court on Tuesday ordered Wikipedia to remove the photograph and name of the resident doctor who was raped and murdered at RG Kar Medical College and Government Hospital in Kolkata. A bench headed by Chief Justice DY Chandrachud took note of the arguments of Solicitor General Tushar Mehta who said the name and photograph of the victim could still be found on Wikipedia.

The Supreme Court said that the law is very clear that the identity of the victim cannot be revealed in cases of rape and murder. It is very important that the identity of the victim should not be revealed in order to maintain the dignity and privacy of the deceased. “Wikipedia will take steps to comply with the order passed earlier,” said Justices JB Pardiwala and Manoj Mishra.

During the trial of this case, the lawyer claimed that when Wikipedia was asked to remove the names and photos of the victims, it refused. He said it cannot be censored. And revealing the identities of the sexual harassment victims is in violation of the order passed in the Nipun Saxena case. In 2018, the Supreme People’s Court gave a verdict in the case.

Meanwhile, the Supreme Court also dismissed Kapil Sibal’s appeal to stop live streaming. Sibal said his reputation and image of 50 years have been tarnished by the judge’s comments on the allegations of laughing in the court during the last hearing. Although he did not laugh at all. Therefore, live streaming of the case should be banned. The bench also held arguments on Tuesday on giving evidence for the investigation.

Kolkata Police said eight hours of CCTV footage had been provided to the CBI, while the investigating agency said it was a 27-minute clip. The bench said first we want to see the CBI report. Kapil Sibal said: “Please listen to us for five minutes before hearing the case. Our request is for live broadcast of the case. If you make any comment, my 50-year reputation will be questioned.”
