On Tuesday (November 5), the Supreme Court made a historic decision. The court said high court judges promoted from the district judiciary will enjoy the same service conditions as those appointed from the Bar. Among other things, the court said the constitution did not discriminate against high court judges on the basis of their source of appointment.
Chief Justice of India (CJI) DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra are hearing a case related to the release of pending salaries of Patna High Court judges. The bench said judges appointed to high courts from district courts will be entitled to the same pension and all benefits as judges promoted from the Bar Council. The judges said that regardless of the source of appointment of High Court judges, it would have no impact on their positions.
“No discrimination in wages or other benefits”
The bench said that the High Court is a constitutional body and its constitutional status is recognized by Article 216. In this context, this article does not discriminate in the manner in which High Court judges are recruited. After appointment, all judges have equal status. They cannot be discriminated against in wages or other benefits.

In fact, some sitting judges of the High Courts had approached the Supreme Court as their salaries were not being released due to closure of General Provident Fund (GPF) accounts. This complication arises when the NPS contributions are transferred to the GPF account of the High Court Judge after his appointment.
