In the rape and murder case of an engineering student, SC banned the death penalty for the murderer. Do you know why?

In a ruling on Tuesday, the Supreme Court stayed the death penalty for a man convicted of rape and murder. The accused raped and murdered a 19-year-old engineering student in Ranchi, the capital of Jharkhand. The 30-year-old man was sentenced to death after pleading guilty.

What did the Supreme Court say when it handed down its verdict?

A bench of Justices Surya Kant, Pankaj Mithal and Ujjal Bhuyan sought translated copies of the records of the trial court and the high court. The court also said it would suspend the death penalty. While issuing the order from the Registrar, the bench directed to obtain copies of the records from the lower courts and the High Court.

This case occurred on December 15, 2016, when a 19-year-old student was raped and strangled to death. An attempt was then made to destroy the body by burning it. Three years after the incident, in December 2019, the trial court sentenced the accused Rahul Kumar alias Rahul Raj to death. The Jharkhand High Court confirmed the judgment on September 9, 2023, upholding the decision of the lower court. Rahul Kumar is a resident of Nawada district in Bihar.

Life sentence for murder charge

In other news, a court in Uttar Pradesh’s Maharajganj district sentenced three people to life imprisonment for kidnapping and murdering a minor boy over a feud. District Judge Abhay Pratap convicted Sagar Madheshiya, Vishnu Madheshiya and Mukesh Madheshiya. were convicted of murder and sentenced to life imprisonment. The court also imposed a fine of Rs 40,000 on each accused.

Another district government lawyer Purnendu Tripathi said the accused in this case kidnapped 17-year-old Aman Madheshiya and then strangled him to death. The incident took place in the Nichlaul police station area. A case was registered against the accused under sections 364 (kidnapping), 302 (murder), 120B (conspiracy) and 201 (destruction of evidence) of the Indian Penal Code (IPC).
