During the hearing on October 15, a bench of Justices BP Colabawala and Somshekhar Sundarshan called this decision of the municipal corporation completely wrong and said that the bill does not prevent a Muslim man from registering more than one marriage as a Muslim individual according to the law, he is Four wives were allowed at the same time.
“Under Muslim personal law, a Muslim man has the right to marry four persons at a time. In this case, we cannot accept the contention of the Thane Municipal Corporation that a Muslim man can marry only once,” the court said. allow. “Registration is available.”
Apart from this, the court also informed that the Thane Municipal Corporation had earlier registered the second marriage of the petitioner.
The court directed the couple to submit all necessary documents within two weeks. After receiving the documents, the municipal corporation was ordered to issue the marriage license within 10 days or refuse to issue the marriage license after a personal hearing. Until then, no strict action will be taken against the woman, whose passport expired in May.
