At present, the biggest question before the Aam Aadmi Party is whether Arvind Kejriwal will get bail? If there is no news of bail for Kejriwal in the reserved decision of the Supreme Court, will the murmur of President’s rule in Delhi that has started today intensify?

President Draupadi Murmu has today sent the letter of BJP MLAs to the Home Ministry, in which eight BJP MLAs and Kejriwal’s former minister Rajkumar Anand have demanded the dismissal of the Delhi government citing constitutional crisis.

The future of Kejriwal government hangs in balance

The future of Delhi’s Arvind Kejriwal government lies between a reserved decision and a letter. The decision which the Supreme Court has to give on Kejriwal’s bail. The letter which the President has sent to the Home Ministry after the demand of BJP MLAs. After this, questions started arising about the government of Delhi’s Chief Minister who has been in jail for more than five months, whether President’s rule can be imposed in Delhi?

On August 30, a letter was signed by eight BJP MLAs and sent to the President, which also includes Kejriwal’s former minister Rajkumar Anand. All of them have demanded the dismissal of the Kejriwal government, for which they have given these reasons-

1. Government work is at a standstill in Delhi. The government is not taking important decisions because CM Kejriwal is in jail and is not able to sign important files

2. The Sixth Finance Commission of Delhi has not been constituted, which was to be constituted in 2021. Due to this, the MCD is not getting enough money. This is a violation of Article 243-1, 243-A of the Constitution.

3. The government has not yet tabled 11 CAG reports in the Assembly.

4. The report given by the Chief Secretary on Delhi Jal Board has also not been placed in the Assembly.

5. Apart from this, the Delhi government is deliberately stopping the schemes of the Centre. For example, Delhi has received Rs 2406 crore under the Ayushman Bharat scheme but the Delhi government is not implementing it.

BJP and AAP are blaming each other

On 30 August, BJP MLAs asked the President to dismiss the Kejriwal government. On 6 September, the President forwarded a letter to the Home Ministry in this regard. After this, Aam Aadmi Party started accusing BJP of bringing down the government through the backdoor and BJP started calling it a ‘straw in the thief’s beard’.

What will happen next?

Amidst the political rhetoric, the question is what will happen next? Now the Home Ministry can ask for a report from the LG. After the LG’s report, the Home Ministry will send the report to the President. Meanwhile, the Supreme Court has reserved the decision on Kejriwal’s bail, which can come anytime.

Who will benefit from President’s rule?

If he gets bail, Kejriwal will be out and will be able to run the government from jail. Even if he does not get bail, Kejriwal will want to run the government from jail. Political experts say that Kejriwal will only benefit from imposition of President’s rule in Delhi where elections are to be held after six months. Then will BJP want to do politics of loss?

President’s rule was imposed in Delhi earlier also

President’s rule was imposed for the first time in Delhi on 16 February 2014, when Kejriwal resigned 49 days after the formation of the government and formed the government with the support of Congress. After the imposition of President’s rule for 363 days till 13 February 2015, Kejriwal again formed the government on 14 February 2015. Aam Aadmi Party won the election with an absolute majority and won 67 out of 70 seats, which is a history in the Legislative Assemblies across the country.
