Green card route becomes difficult for immigrant spouse of American citizens

Washington:

Marrying an American citizen or a green card holder is no longer a smooth sailing ride for the American dream for immigrants. Amid action on US President Donald Trump’s immigration, the US administration has adopted strict policies to shape the current immigration processes-an opposite opposite from the policies of the-Bide-era, when sometimes forgiven the interviews of immigrant husband and wife.

While the marriage-based green card application always involves an interview phase, in recent months, a change with administration was observed, in which a more intensive veating process was adopted. According to a report by the Times of India (TOI), authorities are requesting detailed documents to outline the minute aspects of the relationship, including knowledge about the life -partner’s sleep habits and allergies.

A immigration lawyer Ashwin Sharma told TOI, “The officials must be looking deep … bending more times in their discretion during the years of Biden. They are already spending more time to verify the marriage, and we are seeing an increase in the requests of the evidence.”

Medical procedure

The important step to get green card clearance is dealing with the interview. If the husband who applies for a permanent residence stays outside the US, the interview will be conducted by the US Consulate officials. Which should apply for the adjustment of the status, with interviews conducted by the Citizenship and Immigration Services (USCIS) of the US-like state US-like H-1B visa already in the United States.

The immigration lawyers warned the applicants to expect detailed inquiry and asked them that all the documents are in order.

“We are watching an increase in requests for evidence, and it is likely that this pattern will soon become an official policy,” called Avjan Attorney Sharma.

Experts said that consular officers are paying special attention to the couple’s story, how they met, their intention to live together, and how they maintained the relationship. And since American citizen husband and wife are not allowed to participate in visa interviews in consular cases, the entire burden of proof lies on documents.

He said, “Documents have to tell the whole story: how the relationship began, the real intention to live a married life together, how it maintains, and why it is.

What evidence can be considered

Managing Attorney Snehal Batra at the NPZ Law Group told TOI that applicants should be prepared with extensive documentation, including money transfer receipts, call logs, photos, joint accounts and even joint life insurance policies.

He said, “In addition, be prepared to answer questions about your spouse’s current employment, salary, education and any pre -marital relationship including any pre -marriage.”

Batra warned that if a green card is “denied for an alleged marriage fraud, then the removal of the husband or wife can be kept in the proceedings (exile).”

Biden-era generosity

The President Joe Biden unveiled the new rules last year, which reduces the process for the unspecified life partner of American citizens to achieve the status of a permanent residence.

The new rules did not expand the eligibility for permanent residence, but also streamlined the process for those who are already eligible. This involves removing a requirement that they leave the country as part of the application process.
