Everyone is stunned to hear about a strange case that has come to light in Allahabad High Court. It may seem strange to hear that even a ghost can file an FIR. Here, in the year 2014, a case was filed against five people of the same family in a land dispute in the name of the deceased person. At the same time, the investigating officer also recorded the statement and filed the charge sheet. Then the case continued. When this matter came to the High Court, the court examined all the aspects and asked the Kushinagar SP – Can a dead person or a ghost also implicate innocent people by filing an FIR?

Actually, the matter is of Kushinagar. Here, in the year 2014, a deceased person lodged an FIR against five people of a family in a land case and the investigator investigating the case recorded his statement and also filed its charge sheet. When the matter came to the trial court, the court also took cognizance of it. When this matter came to Allahabad High Court, the court quashed the case after hearing it and asked the SP to find out how a ghost is trapping innocent people.

It is noteworthy that the accused Purushottam Singh, resident of Hata police station area of Kushinagar, along with his two brothers and two sons, challenged the charge sheet filed by the police in the Allahabad High Court. Information was given in the court of Justice Saurabh Shyam Samseri that in the year 2014, a person named Shabdprakash lodged an FIR of fraud against Purushottam and others. Whereas Shabdprakash died in 2011.

Petitioner’s advocate Rajesh Kumar Singh has argued that the accused are having an old land dispute with the deceased Shabd Prakash and despite the death of the plaintiff Shabd Prakash, the investigator of the case has recorded his statement and also filed a charge sheet against everyone. The advocate also included the death certificate given by Mamta, wife of deceased Shabda Prakash.

At the same time, the court was also surprised to hear this case and asked that when the plaintiff Shabd Prakash had died in 2011, then in 2014, whether Bhoot had filed that FIR and whether the investigation had recorded Bhoot’s statement and filed the charge sheet. And in 2023, the ghost itself has put its signature on the affidavit filed in the High Court to oppose the petition?

Hearing the entire case, the court has canceled the charge sheet filed against accused Purushottam Singh and his family members and has ordered SP Kushinagar to investigate the matter. It is said that find out how a ghost is troubling innocent people by filing cases against them? Besides, the SP has also been asked to give information as to how the investigators have recorded the statement of the ghost?

Expressing strong displeasure in this matter, the court has sent a copy of this order to the President of the Bar Association and asked him to advise the advocate who filed the Vakalatnama in the name of the deceased plaintiff Shabdprakash to be cautious in future.
