Delhi High Court says petition alleging sexual harassment in film industry dismissed – based on mere speculation.

The Delhi High Court on Thursday dismissed a petition alleging sexual harassment in the film industry. A PIL has been filed in court regarding allegations of sexual harassment in the film industry. Meanwhile, Acting Chief Justice Vibhu Bakhru and Delhi High Court Justice Tushar Rao Gedela refused to consider it.

The judge said an unreasonable investigation cannot be ordered in the absence of a complaint from the aggrieved party. The petitioners cited the Hema Judicial Commission report on sexual harassment cases in the Malayalam film industry. She also demanded that the National Commission for Women be directed to investigate allegations of violation of fundamental and human rights in the Indian film industry.

The entire petition is based on mere speculation – Court

“When the complaint comes, we will investigate,” the bench said. Your petition is based on the Hema Judicial Commission report, which is being considered by another court. We will not order an investigation of any kind. The complainant, Ajeesh Kalathil Gopi, alleged that sexual harassment exists across the film industry. He has also complained to the relevant authorities.

He also demanded that the committee’s report be submitted verbatim to ensure transparency. However, the court said the complaint should come from the victim. The judge said the entire petition was based on mere speculation without any data or facts.

“We don’t think it’s appropriate to accept this”

The court said the action was initiated based on the report of the Hema Judicial Committee set up following complaints from victims. The court said: “There is no complaint of sexual harassment made by any particular person in the petition. In the circumstances, we do not consider it appropriate to entertain the claims made in the petition.
