New Delhi: The Delhi High Court has ordered the deletion of deepfake content against India Television chairman and editor-in-chief Rajat Sharma while protecting his personality rights. Justice Amit Bansal ordered the eight accused individuals and entities not to use Rajat Sharma’s name, face, image in any manner through artificial intelligence (AI) or deepfake without his express written permission , sound, photos, videos, etc. business or personal interests.

The order upheld a petition filed by veteran journalist Rajat Sharma, in which he alleged that the defendants misused artificial intelligence technology and used his face, voice and other personality features through the technology to create fraud sex videos. is produced by changing it. Further, Rajat Sharma also alleged that the defendants were using the registered trademark of India Television without authorization and clips from its show “Aaj Ki Baat: Rajat Sharma Khosas”.

‘The balance of convenience also favors the plaintiff’

Rajat Sharma also noted that such misuse of his personality, especially by spreading health-related false information, could pose a threat to people’s health and safety. “Having regard to the aforesaid circumstances, prima facie the case appears in favor of the plaintiff and in favor of the defendants,” the court said in its order. The “balance of convenience” also favors the plaintiff and goes against the defendants. If the defendant is allowed to continue publishing the above-mentioned infringing posts/videos, the plaintiff will suffer irreparable harm.

Court directs removal of false content

The court ruled against Meta Platforms Inc. (including Facebook and Instagram) to immediately remove false content shared by the defendant. The court said: “If the plaintiff comes across any false or forged video which has nothing to do with the plaintiff during the pendency of the proceedings, the plaintiff has the right to contact defendant No. 9 and inform him of any such information.” Published/Video/ is free to request blocking/removal text or any content posted on or used on its platform and an affidavit will be filed in this court.
