Artur Nikita’s son is four and a half years old.

Before committing suicide, Artur expressed his last wish to give custody of his son Viom to his parents. But is this legally possible? Because Atul’s son is only four and a half years old. In this case, custody of the child is always given to the mother. If the child is over 5 years old, the custody rules are different.
Atul’s parents said – Vyom is the last trace of our son. The courts should hand him over to us. We will take good care of him. We want to spend our last moments with our grandson. Artur is no longer with us, but if our grandson remains with us, perhaps some of the wounds in our hearts will be lessened.
Now, Atul’s wife, Wim’s mother Nikita, has been arrested by the police. The grandmother and uncle have also been arrested, so in this case the court may give custody of the child to his grandparents. Currently, there is no information on Viom’s whereabouts.

Some rules related to child custody:
- Generally speaking, if the child is under 5 years old, custody is given to the mother.

Atul Subhash, an artificial intelligence software engineer living in Samastipur, Bihar, committed suicide on December 9. The case has repeatedly made national headlines. Before embracing death, Atul left a 24-page suicide note and made a one-hour video and shared it on social media. Here, Atul identified five people as responsible for his death. Said: My wife, mother-in-law, brother-in-law, uncle, and father-in-law constantly torture me for money. A total of 9 false cases were filed against me.
“The wife left the house herself”
Atul said: My wife left me and went to her parents’ house. He also took his son Viom with him. For three and a half years I had longed to see my son. I wasn’t even allowed to see his face. He was also never asked to speak. I had even forgotten what my son would be like. Whenever I see an old photo, I think of her face. My wife turned my son into a tool to extort money from me. My mother-in-law and brother-in-law borrowed 1.6 million rupees from me. Then he demanded another 50 lakh rupees. When I refused to give them more money, these people started playing dirty games on me.
Maintenance requirement 80,000 rupees
In the video, Atul said: Someone made a demand of Rs 1 crore in front of me. Then he asked his son for monthly living expenses of 40,000 rupees. I used to pay alimony to my son. But later this amount was increased to Rs 80,000. My own salary is not that much. Where did I get so much money? Still, he was not satisfied, so he started asking me for Rs 3 crore. When I said in court that people who give so much money would kill themselves. To which my wife said you should kill yourself too. Judge Sahiba did not say anything to his wife about this. Instead, she started laughing. Instead, she told me to give her Rs 5 lakh and I would solve the problem. Judge Sahiba Rita Kaushik also tortured me a lot for money.
Arrested on December 14
Atul then committed suicide. On December 10, based on a complaint by Atul’s brother Vikas Modi, the Bengaluru police registered a case against Nikita Singhania, Nisha, Anurag and Sushil. Four days after the case was filed, 14 police officers successfully filed the case. Nikita was arrested in Gurgaon. Atul’s mother-in-law Nisha and brother-in-law Anurag were arrested from Prayagraj. All three were produced before a Prayagraj court and taken into judicial custody. Meanwhile, the manhunt for the fourth accused in the case, Nikita’s uncle Sushil Singhania, is underway.
