Bikaner House
Delhi’s Patiala Palace Court has ordered the seizure of the Bikaner Palace owned by the Nokhtar Municipal Council in Rajasthan. The order was issued after Enviro Infra Engineers Private Limited failed to pay Rs 50.31 million despite an arbitration order.
Passing the order, Patiala House Court District Judge Vidya Prakash said the 2020 arbitration award in favor of Enviro Infra Engineers Pvt Ltd has become final after the city government dismissed an appeal filed earlier this year. Citing Koi’s failure to comply with the directive, the judge passed an order and directed the city’s attorney to attend the next hearing. The court will hold the next hearing on the case on November 29.
What did the court say?
Earlier, in the order passed on September 18, the bench had said that the court’s directions were not followed. The judge said the debtor failed to comply with instructions to file an affidavit of assets despite repeated opportunities, but the court considered the arguments advanced on behalf of the decree holder (DH) while concurring with the court’s view. It was held that this was a suitable case for issuing a writ of attachment against the immovable property of the debtor, namely the Bikaner house.
The court made the above ruling on the request for enforcement of the arbitral tribunal’s decision made on January 21, 2020. The judge said the court had ruled that the city of Norka could neither sell the property nor transfer it as a gift or otherwise. The judge directed Norka city representatives to attend the next hearing on Nov. 29.
