The Supreme Court quashed the Rajasthan High Court order which had quashed the sexual harassment case on the basis of the agreement. Justice CT Ravikumar said in a ruling that the controversial order of the Rajasthan High Court was quashed. The FIR and criminal proceedings will be conducted in accordance with the law. We have no comment on the merits of the case and gratefully acknowledge the service of amicus curiae.
The Supreme Court said the crime was one of intransigence. In the circumstances, the order of the High Court was not appropriate. The court made the decision while hearing the case of a 15-year-old girl. Appeal to the Supreme Court in a case of molestation of a minor.
The matter will be investigated again
In this case, a case was registered after the father complained that the minor was being harassed. A first information report was filed based on the same complaint. Subsequently, a settlement was reached through negotiation between the defendant and the victim. The accused appealed the sexual harassment case to the High Court. The Rajasthan High Court concluded the criminal case against the accused after a hearing.
In this case, a third party challenged the decision before the Supreme Court. In a petition filed in the Supreme Court on behalf of petitioner Ramji Lal Bairwa, it was asked whether the High Court can quash the use of powers conferred by Section 482 of the CrPC in cases of sexual harassment? Asked whether a sexual harassment case can be ended by the defendant and the victim reaching a compromise? The Supreme Court said it would look into the matter. The Supreme Court said the decision of the Rajasthan High Court was incorrect.
