Allahabad High Court
The Allahabad High Court expressed displeasure over the delay in investigation by the economic crimes branch of the Uttar Pradesh Police. The court noted that investigations into EOW cases often last for years, leaving victims without time to seek justice.
The high court also directed EOW director general Prashant Kumar to file a personal affidavit by December 16. The court has asked him to provide information on the reasons for delays in investigations into pending cases, the names of the officials responsible and the steps taken to bring the investigation to a speedy conclusion.
Seeking reply from UP DGP
Bench of Justice Samit Gopal made the order during the hearing of the anticipatory bail application filed by Mohammad Harun. In 2019, action was taken against Mohammad Harun under the Prevention of Corruption Act. In the same case, Harun filed an anticipatory bail application.
The court also directed the UP DGP to provide information in the matter. While issuing the order, the court also made it clear that if arrested in the case, the accused will be granted interim anticipatory bail until the next date of hearing.
No reply was received for previous orders
The issue first came up in court in March when the state government was directed to file a counter-affidavit to the court within four weeks. But during Wednesday’s hearing, it emerged that even after eight months of the court’s direction, no response had been received from the state government.
During the hearing, the government lawyer said that he also did not get any information about the matter from the UP DGP office. Taking into account the seriousness of the case, the court also directed the government lawyers to remain in the courtroom during the next session. The next hearing in the case will be held in the High Court on December 16.
