In a significant remark, the Supreme Court on Thursday said the stringent provisions in the law for the welfare of women are not intended to punish, threaten or extort money from their husbands. A bench of Justices BV Nagarathna and Pankaj Mithal made the statement while hearing a case related to separation of a couple. The bench clarified that Hindu marriage is a sacred custom meant to strengthen the foundation of the family and not a commercial arrangement.
‘Strong safety and welfare regulations’
The court said that the Supreme Court has repeatedly expressed strong opinions on the application of various sections of the Indian Penal Code, especially in cases related to matrimonial disputes. These include crimes such as rape, criminal intimidation and abuse. The court also said that women need to understand that these strict legal provisions are for their safety and well-being. These should never be used as a means to punish husbands, intimidate them, dominate them, or extort money from them. “
‘Some women abuse these serious accusations’
The comments were made in a case in which a husband was ordered to pay permanent alimony of Rs 12 crore to his wife as full and final settlement of all her claims. The judge stated that the relationship between the parties had completely broken down and ordered the dissolution of the marriage. However, the court expressed concern about cases where wives and their families used criminal complaints to bring demands against husbands and their families, appealing to the seriousness of the offence. The court said some women misused these serious charges and that was not the purpose of the provisions.
The Supreme Court also said that the police tend to act hastily in such cases and arrest husbands and their relatives, including elderly parents and grandparents, without any solid basis. The judge said that due to the seriousness of the FIR offense, the lower court would not grant bail to the accused. (language input)
