When is membership canceled for caning breach?
When the One Nation, One Election bill was introduced in the Lok Sabha, 20 legislators from the BJP were absent. The same was true when the party issued a three-line whip. Now, in this matter, the party has issued notices to all MPs who did not attend Parliament despite the whip being issued.
The party high command will decide what further action will be taken against these MPs, but there have been many instances in the past where membership of MLAs and MPs has been lost in whip breach cases.
Which MPs are absent?
The first name on the list is Union Minister Giriraj Singh. Apart from Singh, they include Jyotiraditya Scindia, Shantanu Thakur, Bhagirath Chaudhary, Nitin ·Nitin Gadkari, Vijay Vaghel, Udayraj Bhosle, Jagannath Sarkar and Jayant Kumar Roy.
The government was humiliated when the bill was introduced due to the absence of these MPs. Only 269 votes were cast in favor of the government, while the opposition had 198 votes against the bill.
If all members were present in the House, about 290 votes would likely be cast in favor.
What are the whip rules in the House of Representatives?
To end the Anti-Defection Law, the central government enacted a law in 1985. After being passed by Parliament, it was included in the 10th Schedule of the Constitution. The law provides for the disqualification of public representatives who defect.
The whip is issued under this Act. It is recommended that action be taken against public representatives who violate caning. The speaker makes the final decision on the proposal.
The concept of whip is associated with British rule. In the UK, political parties use it for grassroots management. There are three types of whips in the Indian parliamentary process.
1. Through a wire whip, political parties inform parliament and members of parliament about the vote. A “one-line whip” allows members to abstain from voting if they don’t toe the party line. This means that if you don’t want to vote, you don’t have to vote.
2. By issuing a two-line whip, a political party can require its members to attend the House of Representatives. No instructions have been issued regarding the whip vote.
3. The three-line whip is considered the toughest whip. In this case, the political party requires all members to attend the House of Representatives and vote in support of the party. Violation of this rule may result in loss of membership.
When is membership revoked for caning breaches?
In Himachal Pradesh, six MPs lost their membership earlier this year on whip violation charges. In fact, the federal assembly elections were held in Himachal Pradesh in April. Six MLAs of the party defied Chief Minister Sukhwinder Singh Suhu and left for Chandigarh.
The rebellion by the MLAs took place during the ongoing budget session of Parliament. The government issued the whip and held a vote to pass the finance bill. Six MPs failed to attend the vote and their memberships were subsequently revoked.
In 2010, Amar Singh and Jaya Prada were also accused of caning violations. There were suggestions at the time that his membership should be cancelled, but Amar Singh immediately moved the Supreme Court. The court granted interim relief to Singh in the case, but Amar himself quit parliament due to his short tenure.
A number of MPs also lost their seats in 2008 over allegations of whip breaches. At that time, a motion of no confidence was moved in Parliament against the Manmohan government. Many MPs, including Congress MP Kuldeep Bishnoi and Samajwadi Party MP Jaiprakash Rawat, were disqualified in cases of irregularities.
