Supreme Court lawyer tells Atul Subhash’s wife will be punished or whole family will be saved

The father of engineer Atul Subhash, who committed suicide in Bengaluru, has refused to bury his ashes. He said he would not bury his son’s ashes until he got justice. Atul Subhas himself also wrote this in his suicide note. He has said that if he does not receive justice, his ashes should be thrown into a gutter outside the court. However, Karnataka police arrested Atul’s wife Nikita and other family members. In this case, Supreme Court lawyer Kanika Bhardwaj narrated the terms under which Nikita can be punished and how much punishment can be given.

Kanika Bhardwaj said that after marriage, men have almost no rights when it comes to domestic violence. He only has the right to divorce, but he cannot bring any lawsuit if the girl suffers domestic violence.

Kanika Bhardwaj said that when Indian laws changed and the Indian Judicial Code replaced the IPC, the Supreme Court had asked the central government to amend Section 498A as it was being misused. However, the Center is not paying attention to this and women are still abusing the law. He said that under Section 498A, if a man or his close relatives molest a girl in any way, they may be punished. The criminal code provides for up to seven years in prison.

The lawyer said the police deliberately set up the wrong road. Sections of unnatural sex, murder and sexual exploitation were also imposed, although there was no evidence of these. Due to lack of information, Atul Subhash could not get proper help. There is a facility to get free information from the Supreme Court but people are not aware of it. Society is also responsible for Atul Subhash’s death because in such situations people have preconceived notions and do not help the person who is under stress. Even from a legal perspective, Atul Subhash had no choice but to divorce. In this case, lack of proper laws is also responsible for the situation.

Nikita may face seven years in prison

Kanika Bhardwaj said that if it is proven that Atul Subhash was forced to commit suicide, his wife Nikita and others responsible could be sentenced to up to seven years in prison. However, this takes a long time. After police investigation, a charge sheet will be filed and the court will then deliver its verdict. It would be difficult to prove in court that Nikita forced Artur to commit suicide, but if proven, Nikita could be jailed and fined.
