The Delhi High Court, while hearing a petition by BJP leader Subramanian Swamy seeking cancellation of Indian citizenship of Congress leader Rahul Gandhi, directed that the same case had been filed in the Allahabad High Court Vignesh Shishir, the petitioner, has two weeks to file an affidavit. The Delhi High Court will hear the case on December 6.

Subramanian Swamy says it has nothing to do with us. The court said, let us see the prayer part of the petition, the prayers made in the petition filed before Allahabad High Court are very broad and will cover the arguments of your petition.

Two high courts are hearing similar petitions
Swamy said, I just want a reply from the Home Ministry on the completion of the process related to my complaint. The Delhi High Court said the petition filed in the Allahabad High Court appears to be quite wide-ranging. We do not want two similar petitions to be pending in two high courts. Subramaniam Swamy said so, but we don’t have to worry about that at all.
The petitioner said the Allahabad High Court had held hearing in the case on October 24. The Home Office has been notified about my representative. The case is at an advanced stage in the Allahabad High Court. The case is being pursued in parallel proceedings in Delhi.
The court said an investigation has been initiated against the petitioner who filed the petition before the Allahabad High Court. Swami said what does this have to do with us? The court said those who filed petitions in the Allahabad High Court should come before us and submit their affidavits.
Delhi High Court seeks affidavit from second petitioner
I am not asking for criminal or civil action, Swamy said. I just question his citizenship. What we are trying to say is that you cannot be a citizen of two countries. I submitted my first representation in 2019, but the government has done nothing for five years.
The court stated that it would be permissible for the second petitioner to file an affidavit. Vignesh Shishir, who appeared virtually in court, told us that the Allahabad High Court has ordered an inquiry into his petition challenging Rahul Gandhi’s citizenship. Therefore, as per his request, he was allowed two weeks to file the said affidavit. The next hearing in the case will be held on December 6, 2024, the court said.
