Mirkipur assembly by-election case pending, high court postpones ruling

The court’s decision on the by-election to the Mirkipur assembly seat in Ayodhya has been postponed. The Lucknow High Court has postponed the decision on the Mirchipur seat by a week. As a result, a decision on the appeal seeking withdrawal of the pending election petition from the Mirkipur assembly seat could not be taken on Thursday. Justice Pankaj Bhatia, while hearing the case, ordered an authorized gazette to be issued within a week. Meanwhile, the court also issued an order to serve notices to all candidates for the 2022 assembly elections. The next hearing in the case will be held after November 2.

During the hearing, Awadesh Prasad’s lawyer expressed opposition to the petition and sought notice to be issued to lawyers of all six candidates. He said the case can only be heard after all parties have been heard. The next hearing in the case will be held after November 2. Due to this delay, the date of Mirkipur Assembly by-election may also be affected.

The hearing of the case will be held after publication in the Gazette.

The petitioners had applied to withdraw the petition on Wednesday and the court is scheduled to deliver its judgment on Thursday. The court ordered that the authorized gazette be published within a week. The case will be heard 15 days after the gazette is published. A bench of Justice Pankaj Bhatia issued the order on an appeal filed by BJP leader Gorakhnath withdrawing the petition.
