UP: Kaushambi Collectorate takes major action to seize 96 bigha lands of Waqf Board

The central government has proposed a new bill on transparency in waqf boards. But Muslim organizations and many political parties opposed the bill. 96 valuable lands of Waqf Panchayat in Kaushambi Kada Dham district have been registered in government accounts. Complete details of the ADM’s judicial branch action have also been sent to the central government. Government advocate Shivmurthy Dwivedi made 4-point suggestions to the central government, which the government accepted.

DM Madhusudan Hulgi said property cases related to Waqf Board have been going on in DDC courts for many years. After the trial, the DDC court ordered that 96 plots of land belonging to the Waqf Board be returned to the village community. Thereafter, 96 waqf lands were protected from encroachment by being registered in government accounts. The Kada Dham 96 bigha land case of Sirathu tehsil has been pending in the courts since 1946 but has not been resolved. The case was heard in the court of the then ADM Judicial Magistrate Dr. Vishram.

Government Advocate (Tax) Shivmurthy Dwivedi studied the case carefully and took action. After careful investigation of the four sites, 96 plots of land were eventually recovered from the Religious Affairs Committee. The land is registered on government accounts. Now, as the entire state comes into action, people are seeking details of the action taken by the then ADM Judicial Court. Government advocates have proposed four points of action for the government. This suggestion has been accepted. This boosts the morale of the DM and other officials.

Government tax advocate Shivmurthy Dwivedi said the Indian government has asked for fresh proposals for waqf land. The opinions of judicial intellectuals across the country were solicited on this issue. We also made four recommendations in our personal capacity as government advocates. The information received from there indicates that your suggestion has been accepted for consideration. As far as the land of Khwaja Kharak Sa Baba shrine is concerned, 96 bighas of land were transferred from the name of the committee to the government account in 2022 before the court of the then Additional District Magistrate. The case has been ongoing since 1946 and the land was said to have been given to him by Alauddin Khilji in a letter of apology.

DM Madhusudan Hulgi informed that the land was registered with the Waqf Board while the case was pending before the DDC court. He came to know that all this land belonged to the Gram Sabha. The DDC court examined the documents and determined to which category the land fell and whether it was Gram Sabha or Kaskaro land. Gram Sabha has land, 96 bighas of land, registered in Gram Sabha, which previously belonged to Waqf Board. If someone violates it, he will be evacuated from there.
