Under the revised norms, the Competition Commission of India can appoint agencies to monitor implementation of its orders

New Delhi, September 18: The Competition Commission can now appoint agencies to monitor implementation of its orders and issue notifications of revised regulations.
The move also comes amid concerns expressed by some entities over non-compliance with certain orders of the regulator, which is aimed at ensuring fair competition in the market.
The Competition Commission of India (General) Regulations, 2024 were published on Tuesday.
Now, the CCI can appoint an agent to oversee the implementation of its orders. These agents can be accounting firms, management consultancies or any other professional organisations, or they can be chartered accountants, company secretaries or cost accountants.
According to the new rules, “if the Commission is of the opinion that the implementation of an order passed under section 31 or section 48A or section 48B of the Act or any other provision and regulations made under the Act requires supervision, the Commission may appoint a body to supervise such implementation on such terms and conditions as the Commission thinks fit.”
Sections 48A and 48B deal with undertakings and settlements respectively, and section 31 deals with merger orders.
Apart from this, the agency is also responsible for informing the CCI of any non-implementation or non-compliance of its orders.
The regulator can appoint agents for various orders, including those related to mergers and acquisitions.
The regulations also make several other changes, including providing for a 180-day period from the date of issuance of an interim order to adopt a final order.
The CCI has conducted a comprehensive review of its general regulations following the amendment of the Competition Act in April 2023. A public consultation was also conducted before the revision of the regulations. (PTI)
