Ali Abbas of Kaushambi district of Uttar Pradesh has become an enigma. Is he alive or dead? To find out this, investigation has been handed over to CBI. Ali Abbas went ‘missing’ last year. Since then it has not been known whether he has died or has been taken prisoner. On Monday, officials said that CBI has taken over the investigation to find out.

He told that CBI has taken over the investigation on the instructions of Allahabad High Court. The agency has been asked to submit its report by August 30.

Ali Abbas was the main accused in the kidnapping of the girl

It is alleged that Abbas, along with his friend Saifi, had kidnapped a 17-year-old girl from her college on April 27, 2023. Abbas’s father submitted a complaint letter to the UP Chief Secretary on May 15, 2023, alleging that Abbas and the girl were murdered by Dilip Yadav, Akash Yadav and others.

The father had accused the son of kidnapping

Later the father sent another complaint letter to the Superintendent of Police through post. In this he claimed that his son and girl were kidnapped and the accused have kept them at an unknown place.

On August 11 last year, the police had recovered the girl and recorded her statement before the magistrate under section 164 of CrPC. The prosecution claimed that Abbas was murdered and relevant sections were added against the accused. To strengthen their argument, the police also claimed to have recovered clothes stained with Abbas’s blood from one of the accused, Guddu.

Guddu’s lawyer told the High Court that Abbas is alive and living with his uncle in Dubai. The police have charged him with murder even without recovering the body.

What did the court say…

The court noted that this is a case where the main accused, Ali Abbas, is a young boy. He has been missing for a long time and the investigating officer has only filed a charge sheet under section 302 of the IPC without recovering the so-called dead body and also without collecting any credible evidence. The police has taken complete action on the basis of recovery of clothes of main accused Ali Abbas.

Officials said that the court called it a serious matter and handed over the investigation to the CBI. The CBI has again registered a case related to the alleged kidnapping of a minor, in which the Kaushambi police had made Abbas the main accused.

As per procedure, the CBI re-registers the FIR of the state police, which is investigating the case, as its own case. The final report of the agency is presented before a special court which may or may not agree with the allegations in the FIR.
